Terms of Use

Last updated: 11 August 2026.

In these terms, “us”, “we” or “our” means CrunchPixels, operator of this website. These terms govern your use of and access to this website, and, where you engage us for a project, the delivery of our web design and film & video production services.

We may change part or all of these terms at any time. The most current version will always be posted on this page. Your continued use of this website after a change constitutes acceptance of it. If you object to these terms or any change to them, your only remedy is to stop using this website.

General terms

1. Jurisdiction

These terms are governed by the laws of Tasmania, Australia. You consent to the exclusive jurisdiction of the courts of Tasmania to determine any dispute arising under these terms.

2. Access

We make every reasonable effort to keep this website available and fully operational, but don’t guarantee uninterrupted or error-free access. Access may be suspended without notice for system failure, maintenance, repair, or any reason beyond our control.

We may change or discontinue any feature of the site at any time, and may terminate or restrict access in response to a breach of these terms, a breach of applicable law, or suspicious activity.

3. Conduct

You must not use, or attempt to use, this website:

  • in breach of any applicable law of Tasmania, the Commonwealth of Australia, or your own jurisdiction
  • to impersonate any person or entity
  • to solicit money, passwords, personal information or other property from any person or entity
  • to harm, abuse, harass, threaten, stalk, intimidate or offend any person or entity
  • to publish personal information about a third party without their consent
  • to publish material you don’t own or have permission to publish
  • to publish pornographic, offensive, or otherwise unlawful material
  • to publish viruses, malware, or other code designed to damage software or hardware
  • to publish advertising for yourself or a third party without our consent

Breaching these rules of conduct may result in termination of your access to this website without warning or notice.

4. Privacy

Please review our Privacy Policy, which also governs your use of this website.

5. Copyright

Except where expressly stated otherwise, you don’t have any right, title or interest in the material on this website. Material on this site may be protected by copyright, trade mark and other laws, and — outside of fair use under the Copyright Act 1968 (Cth) or normal browser caching on your own device — must not be reproduced, stored, published, altered or transmitted without our prior written consent.

6. Third parties

This website may link to external websites that aren’t within our control and aren’t part of this site — we’re not responsible for their content. If you contact a third party as a result of visiting this website, we’re not responsible for any dealings between you and them.

7. Limitation of liability

Your use of this website is at your own risk. To the extent permitted by the Australian Consumer Law and other applicable legislation, this website and its content are provided “as is”, and we make no warranties as to the accuracy of information on it. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law that cannot lawfully be excluded.

Engaging our services

8. How a project works

Descriptions of our services on this website are general and indicative. The specific scope, deliverables and timeline for your project are set out in a written quote or proposal, which forms the basis of our agreement once you accept it.

9. Payment

Prices are quoted in Australian dollars and, unless stated otherwise, include GST. Most projects require a deposit before work begins, with the balance payable on agreed milestones or on completion, as set out in your quote. Invoices are sent by email — please make sure the address you’ve given us is correct.

Where you pay by card, we don’t store your full card number — payment is processed securely by our payment processor.

10. Ownership and delivery

Ownership of the final deliverables (such as a completed website or finished video) transfers to you on payment in full, unless otherwise agreed in writing. Work in progress, drafts, and any third-party licensed material (such as stock assets not purchased outright) remain subject to the terms under which they were supplied.

11. Changes and cancellation

Changes to an agreed project scope may affect price and timeline, and will be confirmed with you before extra work begins. If you need to cancel a project already underway, you’re responsible for the cost of work completed and any commitments we’ve already made on your behalf (such as booked shoot days or purchased assets). Nothing here limits any right you have under the Australian Consumer Law to a refund or remedy where our services haven’t been provided with due care and skill.

12. Security

We use industry-standard encryption where applicable to protect information in transit between you, this website, and our suppliers. No method of transmission over the internet can be guaranteed completely secure, and you provide information to us online at your own risk.

13. Limitation of liability

To the extent permitted by law, our liability for any claim arising from a project is limited to the amount you paid us for that project. This clause doesn’t limit any liability that can’t lawfully be limited, including under the Australian Consumer Law’s consumer guarantees.
